This interactive workshop will cover the main issues that HR professionals and managers face from the beginning to the end of the employment relationship.  As well as the legislation and case law on issues from recruitment to post employment obligations, this workshop will work through several scenarios that those managing employees face on a weekly basis. 

Learning Objectives:

  • Enhance your understanding of the legal requirements around recruitment. 

  • Gain confidence on how to apply trial or probationary periods and be compliant. 

  • Walk away with a clear understanding on the different ways an employment relationship can end – both procedurally and what you need to justify such a decision. 

  • Develop a strong understanding of the current legal position on restraints and what they can look to confidently enforce.

  • Informal management of performance 

  • The role of the mid-year review 

  • When does it need to go formal? 

  • Managing bullying and harassment claims 

  • Changes to the role – what triggers a restructuring process? 

  • Process to introduce new terms and conditions of employment or policies  

  • What if an employee receives an overpayment of wages.  Can this just be deducted from their next pay?

1:30 An overview of the ways an employment relationship can end 

  • Do you always have to accept a resignation? 

  • What if you receive a resignation in the heat of the moment – do you have to give a cooling down period?

  • Does an employee have to tell you why they are leaving and where they are going?

  • Adhering to a Record of Settlement 

  • References – what can employer say and not say?
